OF EASTERN NEW MEXICO UNIVERSITY ROSWELL BRANCH COMMUNITY COLLEGE BOARD AUTHORIZING AN ELECTION FOR THE PURPOSE OF SEEKING TO ESTABLISH A MILL LEVY
WHEREAS, the Eastern New Mexico University Roswell Branch Community College Board (herein the "Board"), in the County of Chaves and State of New Mexico, is empowered and authorized by NMSA 1978 § 21-14-2 to conduct the election for ad valorem tax levies within the Eastern New Mexico University Roswell Branch Community College District (herein, the "District"); and
WHEREAS, there is currently in effect within the District an ad valorem tax rate of one dollars ($1.00) for each $1,000.00 of net taxable value of property for the purpose of raising operational revenues;
WHEREAS, there is a need in Chaves County for more skilled workers in the construction fields as a result of the damage caused by the floods impacting Chaves County in October 2024;
WHEREAS, there is a need in Chaves County for more trained health care professionals due to provider shortages in Chaves County;
WHEREAS, the Board has determined, and hereby does determine, that it is necessary and in the best interests of Chaves County and the Eastern New Mexico University Roswell Branch Community College and District to establish the ad valorem tax rate at two dollars ($2.00) for each $1,000 of net taxable value of taxable property, with all proceeds of such tax to be used for the operations, maintenance and capital improvements of Eastern New Mexico University Roswell, including improvement to Eastern New Mexico University Roswell's career and technical education programs, pursuant to NMSA 1978, § 21-2A-5;
WHEREAS, if passed, this ad valorem tax rate increase would generate approximately $1,350,000 annually in additional funding for improvements to Eastern New Mexico University Roswell's career and technical education programs;
WHEREAS, no unsuccessful election for a mill levy increase has been held within the District for the Eastern New Mexico University Roswell Branch Community College within the past two years; and
WHEREAS, the Board has determined that an election shall be held to seek voter approval to establish the mill levy within the District on Tuesday, November 4, 2025, in accordance with NMSA 1978, §§ 21-2A-1 through 21-2A-10.
NOW, THEREFORE, be it resolved by the Eastern New Mexico University Roswell Branch Community College Board, in the County of Chaves and in the State of New Mexico that the following proclamation is hereby issued.
Proclamation
Section 1. On Tuesday, the 4th day of November, 2025, there will be held in Chaves County, New Mexico, an election (herein the "Election"), within the District, at which time there shall be submitted to the registered, qualified electors of the District, the following question:
Shall the Eastern New Mexico University Roswell District expand its career and technical education programs through imposing a property tax levy of $2.00 per each $1,000.00 of net taxable value on all taxable property within the Eastern New Mexico University - Roswell District (an increase of $1.00 per each $1,000.00 over the current tax levy rate of $1.00 per each $1,000.00 of net taxable value)?
Section 2. The Election to decide the above question in the District shall be conducted and canvassed pursuant to the provisions of the Local Election Act, NMSA 1978, §§ 1-22-1 et seq.
Section 3. The President of Eastern New Mexico University Roswell is directed to file a copy of this Resolution and Proclamation with the County Clerk of Chaves County pursuant to the deadline established in NMSA 1978, §§ 1-16-3.
Section 4. The President of Eastern New Mexico University Roswell is directed to post a copy of this Resolution and Proclamation on the Eastern New Mexico University Roswell website pursuant to the deadline established in 1.10.16.8 NMAC.
Section 5. The President of Eastern New Mexico University Roswell is hereby authorized and directed to take all actions necessary or appropriate to effectuate the provisions of this Resolution and Proclamation.
Section 6. All actions heretofore taken by the Board, the President of the Board, the Secretary of the Board and the President of Eastern New Mexico University Roswell and his agents to facilitate and effectuate the Election that are not inconsistent with law and the provisions of this Resolution and Proclamation are hereby ratified, approved and confirmed.
