1. Purpose. The Roswell Branch Community College Board (a.k.a as the Community College Board) has a contractual agreement with the Board of Regents of Eastern New Mexico University. The agreement provides for the operation of a branch community college of Eastern New Mexico University. The operating agreement sets forth the terms and conditions for the operation of the institution which is known as Eastern New Mexico University-Roswell (ENMU-Roswell).
The Board of Regents of Eastern New Mexico University (hereinafter referred to as Board of Regents), Portales, New Mexico, and the Community College Board (hereinafter referred to as the College Board which is comprised of the joint Boards of Education of the Independent School Districts of Dexter, Hagerman, Lake Arthur and Roswell) hereby enter into the following agreement concerning the operation of Eastern New Mexico University‑Roswell (sometimes referred to as a "branch") located in Roswell, New Mexico.
Duties and Responsibilities
The duties and responsibilities of the College Board in relation to the operation of Eastern New Mexico University‑Roswell are as follows:
1. Act in an advisory capacity to the Board of Regents in all matters pertaining to the conduct of Eastern New Mexico University‑Roswell. This is accomplished operationally through membership of the respective Board Presidents serving on the Community Advisory Council and by recommendations from the College Board as a whole to the President, ENMU and the Provost, ENMU‑Roswell;
2. Approve the annual operating budget for the ENMU‑Roswell campus for recommendation to the Board of Regents;
3. Certify to the Chaves County Commissioners the full‑time equivalent tax levy;
4. Conduct elections for tax levies for Eastern New Mexico University‑Roswell; and
5. Meet with the Provost and/or President at least twice annually.
The Board of Regents, through its appropriate university representatives, shall have full authority and responsibility in relation to all instructional and administrative matters of the branch. Eastern New Mexico University (hereinafter referred to as ENMU) will serve in a supportive capacity for Eastern New Mexico University‑ Roswell. Certain policies in the agreement follow, but it is recognized that unanticipated circumstances may require changes in policies. Such changes will be determined through conferences between the appropriate representatives of the administration, the Board of Regents, and the College Board to be approved at a later date by both boards.
Policies:
1. Eastern New Mexico University‑Roswell will be operated in accordance with the standards of the North Central Association for the Accreditation of Schools and Colleges and under appropriate state statutes and the rules and regulations of appropriate state agencies governing parent institutions and branch colleges.
2. The mission and purposes of ENMU‑Roswell are those common to community colleges and include:
a. Providing lower level coursework applicable to baccalaureate degrees at ENMU and other institutions of higher education.
b. Providing vocational‑technical education in selected occupations.
c. Providing continuing educational opportunities for social, cultural, vocational and avocational advancement.
d. Providing developmental/basic education programs to compliment student development including guidance, counseling, and advisement services.
3. The instructional program of ENMU‑Roswell shall be designed to accomplish its stated purposes but still be consistent in its lower division courses to those comparable courses at ENMU.
4. The instructional program is subject to appropriate coordination and regulation by ENMU, but responsibility for determining courses of study, program content, and course scheduling shall rest with the appropriate administrative offices of ENMU‑Roswell.
The University Curriculum Committee will:
a. Review and recommend academic courses that differ from those listed in the undergraduate catalog involving the same discipline(s) which are developed by one of the coordinate campuses, especially those courses considered for transfer or articulation into a baccalaureate degree program;
b. Review and recommend academic degree programs that are offered jointly by two or more of the coordinate campuses in order to maintain levels of consistency;
c. Not review and recommend on new academic degree programs developed at a coordinate campus; however, an agreement in writing from the Dean of the College at ENMU most affected by the transfer potential of a new program should be obtained, and the program should be submitted to the Academic Council for approval;
Information regarding associate of applied science degrees (vocational) should be made available to the Academic Council. (Ref: Academic Council Policy, 11/8/83).
5. ENMU shall honor credits earned through lower division courses at ENMU‑Roswell as though they were earned at ENMU‑Portales, subject to the following conditions:
a. Credits earned in lower division courses (those numbered 100 or 200 which appear in the ENMU undergraduate catalog shall be a part of the University parallel program at ENMU‑Roswell and shall receive resident credit from Eastern New Mexico University, subject to University regulations concerning graduation requirements and college degree plan requirements as stated in the undergraduate catalog or in the college degree plans available through the college dean.
b. ENMU‑Portales will accept from ENMU‑Roswell completed courses included in approved associate of science and associate of arts degrees as well as other lower division academic coursework. The total number of lower division credits which may apply toward a baccalaureate degree will be determined by an individual degree program. Among the semester hours normally required in the baccalaureate degree are 40‑50 semester hours of upper division coursework.
c. Any lower division courses designed to meet the needs of the local educational clientele and that do not appear in the ENMU undergraduate catalog or schedule will be articulated in accordance with policies for new course development. These courses may be honored as a part of a parallel program of study by the other coordinate campuses. The transferability of such courses will be at the discretion of the institution receiving the transfer student in consultation with the appropriate campus administrator(s).
6. The admission criteria shall be established by the Board of Regents. Such admission criteria shall follow commonly accepted criteria for "open door" two-year institutions.
7. Personnel policies governing hiring, evaluation, promotion, retention, dismissal and compensation of faculty and staff shall be established by the Board of Regents giving due consideration to Affirmative Action and Equal Opportunity regulation, statutes and guidelines. Such policies shall be appropriate to faculty and staff at two‑year campuses but wherever appropriate shall be comparable to policies governing university employees.
8. ENMU‑Roswell shall award the degrees of Associate of Arts, Associate of Science, Associate of Applied Science, and Certificates of Completion (for programs requiring less than the equivalent of two years for completion) to students who successfully meet the requirements established for such degrees or certificates.
9. Depending upon the availability of space and to the extent it is economically feasible, the physical facilities of ENMU‑Roswell will be made available to ENMU for provision of upper division and graduate courses. Such offerings will be coordinated through appropriate administrative staff at both campuses. The employment of ENMU‑Roswell faculty and/or staff for teaching upper division and/or graduate courses at ENMU‑Roswell shall be carefully coordinated to insure quality of teaching faculty and to prevent excessive work loads.
10. Fiscal administration of Eastern New Mexico University‑Roswell shall be coordinated with ENMU's Business Office. Appropriate records of financial transactions shall be maintained by ENMU and/or ENMU-Roswell including receipts and records of disbursement. Policies and procedures concerning the maintenance of the funds, budgetary planning, and approvals shall be established and reviewed by the appropriate administrative staff and the Board of Regents periodically. Fiscal support of Eastern New Mexico University‑Roswell will principally come from following sources:
a. State appropriation as provided by law;
b. Local tax support as provided by law;
c. Student tuition as established by the Board of Regents;
d. Fees as established by the Board of Regents and approved by the Commission on Higher Education; and
e. Grants, gifts, and other funds that may be available. No funds of ENMU shall be allocated for the support of Eastern New Mexico University‑ Roswell, although indirect administrative costs may be borne by ENMU. No funds of the Roswell branch may be diverted to the ENMU campus or to any other branch, except for the payment of the budgeted indirect administrative overhead or other appropriate purchases of goods or services. Normal services provided by ENMU through the administrative overhead arrangement include, general support, personnel, staff development, internal audit services and leadership. Legal services, architectural services and liability insurance for ENMU‑Roswell employees will be provided by ENMU‑Roswell.
Terms:
This agreement shall be for the two‑year term from July 1, 2000, to June 30, 2002, and shall be binding upon the Board of Regents of ENMU and the College Board for ENMU‑Roswell. This agreement may be terminated by mutual consent, or it may be terminated by either board upon six months notice. Such termination is to be effective at the close of the academic year following expiration of such six months notice. In the event that the College Board should be unable to meet, with a duly qualified quorum, for the purpose of approving this agreement prior to the expiration of the agreement, this agreement shall remain in effect until after the College Board has met, with a duly qualified quorum, and has taken action on the operating agreement.
